Sales Terms & Conditions
It is important that you read and understand these terms and conditions before proceeding with this transaction. If there is any term that you do not understand or do not wish to agree to, please discuss it with a representative of Titan Fine Art. Only proceed with this transaction if you wish to be bound by the terms and conditions set out below.
1. PURPOSE AND EFFECT
1.1 These terms and conditions set out all the terms of agreement other than price between you as buyer and us as seller, in relation to the sale and purchase of the item or items identified in the invoice, which we refer to below as “the work”. We confirm that we either own the work or are authorised to sell it on behalf of the owner.
1.2 If you wish to rely on any variation of, or addition to these terms and conditions, you must ensure that the variation or addition has been agreed in writing.
2. STATEMENTS ABOUT THE WORK
2.1 Every item has been extensively researched and Titan Fine Art guarantee the age, authenticity, and medium of an item. Other information can be based on a consensus amongst industry professionals at or about the time of the sale, who are some of the best in the field. Prospective buyers purchase on the understanding that some information may be subjective and can differ amongst the art world.
3.1 While we will on request explain the condition of the work as visible to us at the time of the sale, this information is provided in good faith and due to the nature and age of many items prospective purchasers should bear in mind that this information may not disclose all imperfections or previous restoration that are not visible to us or concealed by layers of paint, varnish, or debris. Our observation is offered as our opinion only and Titan Fine Art is not liable for any errors or omissions contained therein. This information should not be a substitute for physical examination by the buyer and buyers are welcome to visit us upon appointment. Colour, contrast, hue etc can vary on different computer displays.
3.2 It is the buyer's responsibility to check the quality and condition of any hardware or fixings at the rear of a paintings to ensure its suitability as Titan Fine Art cannot be held responsible for any damage caused by ineffective or inadequate fixings. We do not change or supply additional hardware (apart from what may already be attached) as this is dependent on the type of wall the item will hang from.
4. PASSING OF OWNERSHIP
4.1 You will only become the owner of the work when the purchase price is paid in full.
5.1 If the work is to be exported from the United Kingdom, whether to other countries within the European Union or outside the European Union, it is the buyer’s responsibility to familiarise themselves with and pay any taxes including but not limited to import tax, duty, merchandise, sales or user tax that have to be paid in the country of destination whether on shipment or on import or at any other time.
6. LAW AND JURISDICTION
6.1 These terms and conditions are to be construed and take effect in accordance with English law. Any dispute(s) arising in connection with these conditions are subject to the exclusive jurisdiction of England and Wales.
6.2 No waiver by the Seller of any breach of the Contract by the Customer shall be considered as a waiver of any subsequent breach of the same or any other provision.
6.3 The Contract and any interest therein is not assignable by the Customer.
